The Amara Estate Owners Corporation is represented by an elected committee. Members are Walter (Chairperson), Donnie (Secretary), Dianni, and Gian. As members of the Committee, we are obligated to follow and enforce any Owners Corporation regulations under Australian Law.
The Owners Corporations Act stipulates that committee members must act honestly and in good faith, exercise due care and diligence, act in the interests of the owners corporation, and not make improper use of their position as a member to gain an advantage for themselves or for any other person.
These Owners Corporations Rules apply to all and Owners and Tenants are therefore obligated to comply in accordance with Sections 128, 136 and 141 of the Owners Corporations Act 2006. It is strongly recommended that you read these Rules to ensure you understand the “do’s and don’ts” of the property.
All complaints regarding a Breach of the Rules must be received in writing together with supporting evidence including, but not limited to, photographs, dates, times and police reports. Complaints must be forwarded to the Owners Corporation Manager via email.
Important Note to Owners: In accordance with Section 136 of the Owners Corporations Act 2006, it is the responsibility of the Owner or Managing Agent to provide the Occupier of the Lot with a copy of the Owners Corporation Rules at the commencement of their tenancy, and a copy of any new Rules as soon as possible after the new Rules have been made.
Residents are not permitted to hang any items on common property, the exterior of a townhouse or balcony area if such objects are visible to other Residents. This includes garments, clothing, sheets, blankets, towels, rugs, or other objects/storage. This does not apply to Residents in townhouses where fold-down clothes lines have been installed by the builder.
Please ensure that all non-visible items on balconies are secured at all times to protect them from the elements. If plants are being kept on balconies, Residents are to take care to avoid excess water flowing when cleaning or watering plants.
Cigarette butts must not be discarded over the balcony or left in ashtrays on your balcony, as winds will carry them through the development.
Alterations to balconies are not permitted without the approval of the Owners Corporation.
The backing colour of any window coverings visible to other Residents from outside of a private lot must be OFF WHITE and no other colour whatsoever.
Window coverings include blinds, shades, window ventilators and other decorative fittings and fixtures.
Bin Boy has been contracted for the on-going waste collections from Amara Estate on behalf of the Owner's Corporation.
Bins are to be placed on the sidewalk on Tuesdays and taken in on Wednesdays.
⚠️ Bins are not to be left on sidewalks or in driveways outside of these times. As per the floor plans, all townhouses are provisioned with an allocated bin storage area.
General waste bins (red tops) are collected weekly on Tuesdays.
Recycling (yellow tops) are collected fortnightly, every alternating Tuesday.
Residents must ensure that the disposal of garbage or waste does not adversely affect the health, hygiene or comfort of other residents.
Common property includes the land and any improvements erected in the Amara Estate outside of private lots.
Residents must not use, or permit the use, of Common Property in a manner that causes a hazard to the health, safety and/or security of any other resident or person who enters the common property.
This includes but is not limited to parks, gardens, walkways, sidewalks, visitors parking and roads in the Amara Estate.
Common Property defects must be reported immediately to the Owners Corporation Manager to be addressed.
In addition to reporting building defects, Residents must notify the Owners Corporation Manager in the case of failure of any building services, or problems with the cleanliness of any public areas.
Building services which are common to all Residents include the entries public lighting, waste management, and common property including but is not limited to parks, gardens, walkways, sidewalks, visitors parking and roads in the Amara Estate.
All matters relating to a private lot are the responsibility of the individual Owner or Managing Agent if you are a tenant.
Subject to case, defects within a private lot are the responsibility of the Owner, not the Owners Corporation.
Private lot defects must be reported to the Builder. The Owners Corporation strongly recommends that lot owners provide as much information as possible, including photographs of the alleged defect.
If you are unsure, please contact the Owners Corporation Manager to confirm.
Tenants are advised to contact their Managing Agent in the first instance.
In the event of a common property related emergency (e.g. major water leak, burst pipe, sewerage overflow) please contact the Owners Corporation Manager.
The Owners Corporation Manager will arrange for the attendance of the necessary contractor/s as required.
IMPORTANT: if the incident is determined to be a private lot owner issue, any costs relating to the callout may be charged on to the Owner.
Residents wishing to view free to air or paid television services will need to install a television antenna for within or on top of the roof of their private lots.
Installation of a television antenna must be completed in compliance with relevant restrictions and all costs associated with access and connection to pay TV are at the
individual lot owners' expense.
It is the Residents’ responsibility to ensure that they are fully operational at all times.
New Victorian Regulations (March 2021)
Changes to the Residential Tenancies Act and its regulations came into effect on 29 March, 2021, imposing significantly more safety and compliance obligations on Victorian property managers and landlords.
Importantly, there is a shift from certain safety measures being recommended, to enforcement of mandatory safety checks including annual smoke alarm servicing and gas and electrical safety checks every 2 years. The services must be completed within the prescribed time frames. Otherwise, they must be carried out as soon as practicable after a lease changes over either from one tenant to another, or from a fixed-term lease to a periodic lease, creating an administrative headache for property managers and service providers alike.
The disposal of hard rubbish is the responsibility of the Resident. Neither Melbourne Owners Corporation Services (MOCS), nor Bin Boys (Waste removal company) are responsible for the removal of hard rubbish.
Hard rubbish items such as bulky packaging materials, unwanted furniture, appliances, or mattresses are not to be stored or dumped on Common Property.
Residents who need to dispose of hard rubbish should contact their nearest Recycling Waste Centre for the proper disposal of hard rubbish.

Any cost associated with the removal of hard rubbish from the site by the Owners Corporation’s waste contractor will be charged on to the Resident.
The Owners Corporation insurance policy will only cover buildings and the common property of the Amara Estate.
The policy will not cover contents of individual private lots. You may wish to consider purchasing a Personal Contents insurance policy.
Please contact the Owners Corporation Manager if you need a copy of the building insurance Certificate of Currency.
Residents may choose a retailer of their choice for telephone and internet services connections at their discretion.
Please contact the Owners Corporation Manager should your contractor require access to Common Property to complete any installation. This should be arranged prior to the technician arriving at site to ensure access can be provided.
Residents must not make noise or permit noise to be made by machinery that may be heard from outside of a private lot between the hours of 4 pm and 8 am.
Residents must not make noise or permit noise to be made from music that may be heard from outside of a private lot between the hours of 10 pm and 8 am.
Residents and visitors must not unreasonably create any noise likely to interfere with the peaceful enjoyment of any other person entitled to use the common property.
Any problems with excessive noise should be reported to the Owners Corporation Manager.
Offender’s will be contacted directly by the Owners Corporation and requested that the noise be lowered.

For all common property after hours emergencies, please contact MOCS by phone. Your call will be diverted to our after-hours emergency contractor to attend to the emergency.
Residents must only use the car space(s) allocated to their respective private lot. This includes the garage and driveway of the private lot ONLY.
Residents are reminded that allocated car spaces are private property. Any oil stains on the concrete are the responsibility of the Resident. Should somebody slip on your car space because of oil, you may be held liable.
⚠️ Visitors parking areas are located around the perimeter of the Amara Estate and are NOT to be used by residents as ordinary parking. Repeat offenders will be issued with a breach notice.
All animals that are to be kept within a private lot must be registered with the Owners Corporation.
All animals must be controlled by the owner at all times. Dogs are to be kept on a leash when on common property.
Any mess or damage on common property caused by an animal is the responsibility of the animal’s owner.
The cost of all cleaning/disinfecting/deodorising and/or any rectification works required will be charged on to the offending animal’s owner.
Any animal reported to be causing a nuisance in Amara Estate will result in a Breach Notice being issued to the animal's owner and if the behaviour persists, the Owners Corporation may order the immediate removal of the animal.
With this in mind, it is in your interest to demonstrate the utmost consideration to your neighbours at all times when keeping an animal within your private lot.
As per section 8 of the Owners Corporation rules, residents must not undertake and renovation or building works within or about a private lot unless they have received received approval from Melbourne Owners Corporation Services (MOCS).
Renovation and building works include but are not limited to solar panel installation, carpet or flooring replacement, additional air conditioning unit installation.
Please submit the proposed Building Works Application and supporting documents, including drawings, plans, product specifications and permits (if any) to Melbourne Owners Corporation Services (MOCS).
Security is the shared responsibility of all Residents at Amara Estate. It is essential that all Residents following the guidelines below:
Report any suspicious activity immediately to the Police by contacting 000.
Leave the access doors/gates open and unattended.
Leave your townhouse or vehicle unlocked at any time.
All townhouses are fitted with smoke detectors. It is the Residents’ responsibility to ensure that they are fully operational at all times.

Remove batteries from smoke detectors
Smoking is not permitted on any part of the Common Property at any time.
Smoking inside of a private lot may result in the fire alarm being activated and the attendance of the Metropolitan Fire Brigade.
Attendance of the Metropolitan Fire Brigade may incur significant fines to the Owners Corporation that will be charged on to the Resident.
Amara Estate has NOT been built with an embedded network. As such you are free to choose to connect with any service provider that is available in the area.
